From John Spirko's Attorney's Regarding DNA testing & Stay of Execution November 7, 2005 We were informed this afternoon on a phone call with Judge Carr (in connection with the DNA case we just filed) that the AG's office will within 24 hours be sending us a letter indicating that it will be making physical evidence available for DNA testing (by the State's labs) and, moreover, will be asking Governor Taft to postpone the execution date so that the testing can be completed before a new execution date is set. We do not know precisely what evidence the AG's office will be making available or how long the testing will take. The AG's office also let us know that it is still looking to locate the fingerprints in order to run them through the national database. We have informed the Sixth Circuit and our contact at Governor Taft's office of these developments. We will send the AG's letter around as soon as we receive it.
